For years now, we have been seeing Apple and Samsung battle it out in court in regards to design patents. Now, it seems Samsung is bringing the iPhone maker back into court for a retrial of $400 million patent damages. Samsung is battling Apple over who owns the concept of smartphones with round corners.
The lawsuit was originally settled in 2012 where Samsung was ordered to pay more than $1 billion in damages to Apple. Samsung has since fought in court to bring the damages down where it now stands at $400 million. A recent successful appeal from Samsung now spells trouble for Apple, where the figure will now be reassessed, again.
Yesterday, Judge Lucy Koh of the United States District Court of the Northern District of Califirnia, made a judgement, then spotted and shared by patent lawyer Florian Mueller. Apple and Samsung now have to decide on a date for the trial and have until October 25th to propose a date. Mueller suggests that there is a 30 percent chance the companies will settle out-of-court instead. The chances of the two companies settling outside the court are slim, but still a chance.
