Uber has settled lawsuit with victim over access to medical records

Uber has settled a lawsuit with a women who was raped by one of its drivers in India. The lawsuit alleged that the company obtained and mishandled her medical records. Court documents filed Friday said that the case would be dismissed in January. The terms of the settlement, however, were not disclosed.

The lawsuit was filed this past June in the Northern District of California alleged intrusion into private affairs, defamation, and publicly disclosing private facts. The lawsuit said that executives at Uber did not handle the records properly and said that the woman was “fraudulently claiming that she had been raped.”

This started when a Uber driver raped the victim in Delhi, India in December 2014. After, she sued the company over the sexual assault, pointing out the company’s negligence and fraud had led to her being attacked. Uber had settled that case in September 2015, and the driver, Shiv Kumar Yadav, was found guilty in October 2015. He was given a life sentence for kidnapping, criminal intimidation, and rape.

The lawsuit is discussion was hit over mishandling of medical records, as reported by Recode and The New York Times. This isn’t the only problem the company has faced. Uber waited a whole year to disclose a data breach it experienced where the hacker stole records of more than 57 million users and drivers.
